​BREAKING NEWS: The European Court of Justice released the Advocate General’s Opinion about the inclusion of Aviation into the EU ETS!

This morning, the Court of Justice of the European Union published the Advocate General’s Opinion in Case C-366/10 between the Air Transport Association of America (ATA) and the Secretary of State for Energy & Climate Change.

In her Opinion, Advocate General Juliane Kokott concludes that the inclusion of international aviation in the EU Emissions Trading Scheme (EU ETS) is compatible with the provisions and principles of international law invoked.

Note: The Advocate General’s Opinion is not binding on the Court of Justice. It is the role of the Advocates General to propose to the Court, in complete independence, a legal solution to the cases for which they are responsible. The Judges of the Court of Justice of the European Union are now beginning their deliberations in this case. Judgment will be given at a later date.
